Acne Issues For Babies And Young People

By Rose Lindy Acne can occur at any age from baby to child to teen to adult. The important thing is to know why acne occurs and what you can do to treat it and prevent it. This article will give you advice about acne that occurs in all age groups and simple things you can do to treat it. Newborn babies often break out with some acne and this is quite natural. It happens because their natural skin oil becomes trapped in hair follicles. This causes a pimple. If this is happening to your baby, you will probably see pimples on their cheeks and possible chin. Do not panic. In fact you do not even need medication for this. If you see acne on your baby just continue to bathe him as usual and be sure to use a soft, clean washcloth. Make sure all your baby cleaning products are hypoallergenic. Baby acne usually clears up by itself so there is no need to call you pediatrician. However, if the condition seems to worsen or does not clear up in a few weeks, you may want to pay a visit to the doctor, this is not usually the case, but it does happen. Prevention and Treatment of Acne in Children Acne in children may not always be prevented. However there are things you can do to minimize the possibility of acne showing up. From an early age teach your child to wash their face once or twice a day with a gentle, hypoallergenic soap. A lot of acne responds well to benzol peroxide, an over-the-counter product. You will find this ingredient in lotions and cremes from different companies. The percentage of available benzol peroxide varies among brands. You will want to test some of whatever you buy on your child before using it to treat the acne. This can be done by applying a little under the jaw. If they are allergic or if their skin is sensitive to that particular product you will know in about an hour. It is important to test this before using it all over their face. You do not want to cause any needless allergic reaction on their face as you can imagine how horrifying it would be for them. You should see improvement within four to six weeks of beginning the treatment. If you there is no improvement or if the acne condition gets worse then you should visit your pediatrician to get advice. The doctor may recommend you to a dermatologist, but that may not necessarily happen. The doctor may be able to make suggestions for treatment without a visit to the dermatologist. Teens With Acne You will probably be surprised to learn that things like eating too much chocolate or oily foods really has nothing to do with acne breaking out. Adolescent and teen acne results from a natural increase in body oil which becomes trapped in pores. Another amazing fact is that if a kid with acne washes their skin too much, the irritation of washing can actually clog pores and cause more acne. If your daughter wears makeup, teach her to buy noncomedogenic makeup products. This type of product is formulated in a way that will not promote acne. Also, help to to establish a healthy bedtime routine of washing her face thoroughly before going to bed. The younger you start this routine, the easier it will be for her to continue it throughout her lifetime. The Five Keys to Powerful Partnerships

By Paul Cutright Partnerships are intentional relationships between two or more
people who want to create a future together. That future
could be anything from a life long marriage to a business
partnership to a short-term project. Your partnerships are
among the most important relationships you will ever have.
And, like all our relationships, they are vulnerable to
misunderstandings, miscommunications, upsets and breakdowns.
Its just that there is often much more at stake in our partnerships. There are five keys necessary to unlock the potential of your most
important relationships, turning them into powerful partnerships.
They are: 1. Practicing High Performance Communication 2. Having a working knowledge of the 5 Stages of Relationship 3. Using a Design Model for your partnership 4. Practicing Radical Personal Responsibility 5. Committing to using your partnership for conscious evolution 1. High Performance Communication Our definition of high performance communication is communication
that is honest, compassionate, direct and honors the dignity of
everyone involved. Relationships live in language. That means that the quality of your
regular, everyday communication determines the quality of your
relationships. Your communication is not just the words you say;
it is how you say those words. The result you get in your
communication with others is determined by your intention.
Your intention is the superior force in any communication
because your intention, conscious or unconscious, is the
carrier wave for the words. People will usually respond to
the energy with which you say something more than the words you say.
Powerful communication is congruent, meaning the words you say are
consistent with your emotions and your intention. Another, often overlooked, part of communication is listening.
As the listener, you have the power to influence the quality of
a conversation by how you listen. Have you ever been in a
conversation in which the person to whom you were speaking
was not listening, or distracted, or thinking about something
else entirely -like what they wanted to talk about?
How did that make you feel? Have you ever done that with anyone?
How does it feel to have someones complete and undivided
attention when you are speaking? How you listen to another,
especially your partners, can have a direct affect on their
self-esteem and their sense of value. The
quality of your communication determines whether you feel

knowledge of the five stages of relationship. The five stages
are Attraction, Power Struggle, Cooperation, Synergy and Completion. The most problematic stages for most people are Power Struggle and
Completion. People often ask us if the Power Struggle stage is
necessary. Who wouldnt want to avoid power struggle? People dont
exactly jump up and down with excitement when they enter that stage,
like they might in the attraction stage! The Power Struggle stage
is necessary in that it is all about building trust. And trust is
necessary if a relationship is to mature. Power Struggle isnt bad,
its just inevitable, predictable, unavoidable and recurrent.
That is, it happens more than once in any long-term relationship.
Why? Because each time you increase the commitment in a relationship,
e.g., investing more time, money, emotion, etc., more trust is
required. Whenever more trust is required, you will temporarily
revisit Power Struggle. The other problematic stage is completion. Everything that is
created has a beginning, middle and end. And that includes your
partnerships. There are four ways partnerships end: 1. death 2. slowly drifting apart 3. abrupt expulsion 4. consciously The first is obvious, as when one of the partners dies. The second
is when partners may be separated by geography, time, interests or
what-have-you. They find little in common to sustain the partnership.
The third occurs with an apparently irreconcilable upset and the
partnership is abruptly ended, usually with very bad feelings. Obviously, the most desirable of the four is consciously, but most
people dont know how to do that. Conscious completion involves
acknowledging what you have learned from the partnership, what
you have contributed to the partnership, making any apologies
that might be necessary and asking for and extending forgiveness. Often, completion is about changing the form of the partnership,
as in parents who are divorcing. They will no longer be in the
form of marriage, but they will continue to be partners at some
level in co-parenting their children. In this case, conscious
completion is very important for developing or maintaining mutual
respect, dignity and caring in the partnership. There are particular skills to learn and master for each of the
five stages and specific things to avoid. We suggest you download
and print out the five stages article and read through the skills
for each stage, checking off the ones you know you need to work on.
This will give you a personalized curriculum for being able to master
relationships and help you to create powerful partnerships. 3. Using a Design Model Would you even consider building a house without an architect
and a blueprint? You wouldnt get some wood, nails and a hammer
and just start putting something together and hope it turned into a
house you would want to live in, would you? People do the equivalent
with their partnerships all the time. They believe it will work
out because it just feels right. Most people leave the success
of their most important relationships up to chance and luck,
in the hope that it will turn out. But, of course, it seldom
does and then they are left wondering, What did I do wrong? Clearly, love and/or good intentions are not enough to guarantee
success in your partnerships. In addition to those things, you also
need a strong measure of education and skill education about what
it takes to have relationships succeed, and skill in standard
practices of success. It also helps to have a good coach to help
you out along the way in applying your knowledge and developing your
practices. Here is a simple 3 part model we have found to be extremely
effective for designing partnerships. Purpose Results Form First, be clear on the purpose of your partnership.
You can get to that by asking why? why are we in this
partnership? Purpose determines the direction you are going in.
Purpose statements are best kept simple and general.
Then, write out the results you want to accomplish.
Those could be feelings, experiences, products or services,
depending on the nature of the partnership. This is where you get
specific. Results are the what. Look to see if the results you
want in your partnership are consistent with your purpose.
If they arent, then you know you will have trouble down the road.
Last, determine the best form to serve your purpose that will help
you achieve your desired results. Some examples of forms of
relationship are friends, teammates, business colleagues, business
partners, dating, engagement, marriage. Form is tied to the roles
you play in your life. Form is all about how you will achieve
your desired results and ongoingly fulfill your purpose. Here is an example of what this might look like. Take two people who
are attracted to each other romantically and are falling in love.
They start talking about building a future together. If they were
to use this design model, they would have deep conversations about
the purpose of their relationship. They may decide their purpose
is simply to bring out the best in each other. The kinds of
results they want to experience in their relationship could
include fun, laughter, deep, heart-felt sharing, travel,
time apart, creativity, sexual pleasure, intellectual
stimulation and community involvement. They would then have
conversations about what the best form might be to accomplish
those results, given their purpose. One of the important things
to remember about form is that form changes. If the couple in our
example is having these conversations as the level of serious
dating, they may look at going steady and being monogamous.
Or if they are further along in their relationship, they
may consider being engaged. All of these are forms, and they
change over time as commitment deepens and trust is developed. 4. Practicing Radical Personal Responsibility Here is something that is very important to understand. Upsets,
disagreements, misunderstandings, miscommunications and
breakdowns are inevitable, predictable and unavoidable in your
partnerships. Now, why in the world would we say something
like that? What about positive thinking? Just look into your
own experience. Havent you had upsets and disagreements despite
your best intentions and despite your positive thinking?
Unfortunately, good intentions and positive thinking are not
enough to avoid or prevent upsets and misunderstandings.
They are a fact of life in human relationships at this stage
of our development. What is really required is a new way of
interpreting these events. And that requires the knowledge
and skill necessary to truly use them as opportunities for
healing and spiritual growth. It is extremely important to have a mutually agreed upon,
pre-determined means for handling these things when they occur.
If you wait to see how you resolve your upsets when you actually
have them, you will be setting yourselves up to lose and possibly

powerful opportunity for your personal and spiritual growth.
And you can truly take advantage of the opportunities present
in your partnerships if you share a commitment to use your
relationship with each other for your mutual growth and evolution. The greatest opportunities for conscious evolution lay your
upsets with others and how you handle them. Practicing radical
personal responsibility means not blaming your partner or yourself.
Rather, you look together to see how you can learn from the upset.
This is based upon the idea that you are never upset for the reason
that you think, and there is value in looking deeper than the obvious.
It is the recognition that most present time upsets are simply an activation of unresolved pain and hurts from the past and
that this current upset is truly a healing opportunity. When you practice high performance communication, when you know
where you are within the five stages of partnership, when you are
using a proven model to consciously design your partnership to be
the way you want it to be, when you can use your present time upsets
to help you resolve your unresolved issues from the past, and
you and your partner have an agreement to be allies with each
other in that process, then you are practicing conscious

10 Slam-Dunk Crafts For Little Kids -- And Bigger Kids Too!

By Chris Yates Crafting with young children really isn't about creating something in particular. Most young children don't have the foresight to see what a project is going to be. For young children it's more important that they have the opportunity to play and experiment with art. Kids need to use as many of their senses as possible to get the most out of crafting. This allow them to try new sensory experiences, as well as learn causal relationships. These are my 10 favorite crafts for little kids based on all that AND the 'fun factor.' 1. Finger painting: Finger painting is a wonderful activity for kids. It lets them 'feel' the craft as well as be creative. You don't have to have finger paints to do this activity with kids. You can finger paint with homemade paint, watercolors or even mud. You can also experiment with adding
other things to the paint such as sand or glitter. 2. Yarn Painting: Dip pieces of string or yarn into paint and then drag it across the paper to paint with it. It's a good experience to paint with something other than a brush and you can just throw the yarn away when finished. 3. Q-Tip Painting: Use Q-tips to create a painting. There are lots of ways to use a Q-tip - scrub, dot, or use it like a brush. It's a good coordination exercise because Q-tips are small around, but it also provides a lot of interest for the child. 4. Glue Art: Draw squiggle lines on a piece of paper or let the child use their finger to make random glue spots or patterns on a piece of paper. Experiment with adding different objects to the glue. Sand, glitter, cotton, yarn, feathers, and tissue paper all work well. 5. Salt Dough Sculpture: Make a batch of salt dough and turn the kids loose with it. You don't have to worry about them eating it (it's safe and tastes terrible) and clean up is easier than play dough. If you want to keep their creations, let them dry overnight and then paint them the next day. 6. Toe Painting: If it's a warm summer day, put on the swimsuits, put some finger paint into pie tins, lay out large sheets of poster paper, and let them 'paint' all afternoon. They will have a ball and all you have to do is hose them off when they are done (that's my kids' favorite part actually!) 7. Found Object Art: This project is always a sure thing because kids love to 'discover' things. Let your child gather up leaves, sticks, flowers, etc. and then glue them onto a piece of paper. When they are done, let them tell you about their collection. 8. Peanut Pictures: Every kid loves to play with packing peanuts -- but it makes such a mess. Let them create pictures with them instead. Kids can draw on them, glue them to a sheet of paper, or glue the peanuts to each other to make a sculpture. The kids will love it! 9. Sticker Play: Turn your child loose with a bunch of stickers, markers, and a sheet of paper and let them create. It's good for little ones to work on their coordination, and it's fun! 10. Stamping: Kids love to use any kind of stamps. My favorites are the self-inking stamps or the double-sided markers with the stamps on one end. Increasing Perceived Value

Intrinsic value is mere physical replacement cost. For example, vitamins have an intrinsic replacement value of a few dollars, but they have a mental and emotional perceived value of comfort, hope, security and peace of mind because of enhanced life condition of well-being and longevity. This is to say that stressing the mental and/or emotional values of a product/service are critical to more sales. Or, if "adding value" to a commodity, the "extra cost", if applicable, is more than justified by the extra perceived mental or emotional value, assuming that you relate all of the perceived value. Is Your Marriage Sinking?

However, if you believe that living under a single roof means you have to compromise with your spouse then your marriage will definitely sink. The word COMPROMISE itself carries a negative energy. You have to eliminate this word from your belief to stop your marriage from sinking. You and your spouse are the pillars that support the single roof under which you live. Both of you have to be equal to stop the roof from tilting. Here, equal does not mean you have to be of equal heights but you have to be equal in carrying out your responsibilities and duties. If one pillar is slightly higher than other then giving half of the difference of pillar heights will make the two pillars equal. This suggests that you should help your spouse in his/her weaknesses so that the roof does not get tilted. For the roof to remain stable and in its position, the pillars have to be strong. This in turn requires the base of pillars to be very strong. In the same way, the base of your marriage which is nothing but LOVE has to unconditionally true and strong. Even the real cement concrete pillars require repairs at many times. Similarly, there may creep some tensions in your marriage and then you need to revive your relationship again. It is infact simpler than repairing a physical pillar. There are so many ways for it. Suppose your spouse is angry and in high-tone, simply be quite and listen instead of following the same track as that of your partner. If you are angry with your spouse on his/her bad habits then simply write few of his/her good points. You change the color of pillars in your house to keep it lively. Similarly, keep doing different funny things with each other to keep your married life as colorful as a rainbow. But, if the pillars height difference is too much then it is better to replace it with an equal pillar rather than repairing it. In other words, if all the ways of having a happy married life are exhausted then it is better to get divorce and if you like marry someone with whom you feel you can erect up a stable roof. To sum up, it can be said that only strong and equal pillars will have a stable roof and those under it will feel lively if pillars are colorful. So, for happy married life, love your spouse immensely and unconditionally. Share responsibilities and duties with each other. Keep doing things that you both enjoy. Designing Your Garden - Focusing On Focal Points

By Glenn Cutforth Gardening time is here again! You have grandiose visions of a lush green paradise, picturesque flower beds and picture perfect tomatoes and other vegetables. You see yourself lazing in a hammock with a good book, and breezy summer nights with neighbors jealous of your good fortune. Right? Well, something like that, I'm sure. However, the reality is that patch of dirt staring back at you is saying something altogether different. It's reminding you of the sweat, time and planning it takes to really have a good garden. It's also telling you to learn from the mistakes you made last year. You don't need to have unrealistic design abilities to have a stunning array of flora to call your own, either. Just a basic understanding of the soil, the needs of each plant, and the watering patterns in your yard. You can begin with a basic shape for your garden. Once you have that in mind, draw it out on paper and make a rough draft of a general plan. This must include some focal points. These are very important as it draws the admirers eyes to these features of your garden. They should be proportionate in size with the rest of your garden and, if done well, can really strike a balance. Think of whether or not you'll be entertaining. Will there be a permanent stone BBQ? Perhaps a pond? An outdoor bar? These can be considered focal points and you must have a place for them and plant around accordingly. You want a continuous flow, not awkward broken up areas. The makeup of your soil is important to understand. You can have your soil tested to see what it's missing nutrient-wise. Usually all it needs is to be well worked with a hoe or a small cultivator with well rotted compost mixed in. You'll want to ensure that all sprinklers are working and there aren't any leaks. In ground sprinkler systems are very pricey, but if you have them, consider yourself lucky! Now that your soil is prepared, sketch out your focal points. Will it be a stone BBQ? Or maybe a fountain-attached or free standing. A small gurgling pond will attract pleasant sounding frogs and fish are a welcome addition for a point of interest. Garden sculptures come in many beautiful varieties as well. When choosing the surrounding plants, keep in mind that taller plants should be in the back, and smaller ones in front. Know which ones spread significantly and these can make good groundcover and filler. Try to have different flowers blooming throughout the entire season. It sounds like a lot of work, but if you have a genuine love of growing things, and the strong desire to have your own backyard paradise, then the payoff is truly great. Getting A Line On Bass Fishing

By Niall Cinneide Bass fishing offers a wide range of ability and challenge for the beginner and the professional. There are several fish in the species line including bluegills, spotted bass, largemouth and rock bass. These are warm water bass. Others such as striped bass, white bass and white perch are a temperate bass. If you are heading out to catch some bass, your first and most important goal is to know where to find them. Where You Have To Look For Bass There are several locations that they like to call home. For one, look in your lakes. You can find a wide range of them in shallow lakes in the south. This is where you are likely to find your largemouth bass. Here, look in the weeds and in the reeds. But, you are likely not to find too many here. They enjoy eating algae and plankton which is not readily available in many lakes. Instead, look to the rivers. The water temperatures and the oxygen levels are just right in many rivers for the bass. Youll need to look just outside the currents direct flow. Look on the downstream side of rocks and fallen trees as this is where they enjoy hiding. To catch them, do some bottom and surface fishing. A great place to find your bass is to look in streams. Here, you will find smallmouth bass in the cooler water of the streams especially just below the rapids. Look in the hiding places such as where erosion has made holes. Look where there are rocks or fallen limbs as well. Look below a dam especially on a hot day. Youll find that they are never in direct current flow. Also, take a look at ponds. These are a source for smaller bass especially near the shore near fallen logs. Of course, look in the reeds. You can fish any of these locations at night for good results too. Remember that bass are looking for prime conditions and will search them out. They are looking for just the right water temperature and water level. They will seek out locations with good food supply and the right sunlight. As for bait, youll want to use a wide range of choices. In still fishing, go with night crawlers, insects and minnows. For bait casting and spinning, use artificial products, trolling with live bait or you can even fly fish for them. For lures, make sure to get at least a five and a half to seven foot rod and your line should be about six to ten pound test. For fly fishing, go with seven to nine feet in rod with a fast taper. You will also need a single action reel that has floating #7 to #9 line with a six to eight pound leader. If you can, take someone skilled at bass fishing with you your first time out. The Frugal Fisherman: Part II

By A.J. Klott For those of you that don't know this, fishermen by nature are a frugal lot. Being penny wise and pound foolish is standard fare, and I am no different. I recently noticed that the felt soles on my wading boots had become worn out on the bottom. I found this out the hard way,of course, discovering this while fishing on the river, going into my rendition of the "slick rock disco", and falling into "the drink".You would think I would have noticed that my felt soles had worn out and that I was now wearing hockey skates in the water, but with my wading boots being much like my car, I just get in them and go. I headed on down to "The Blackbird", which is my favorite outdoor store--(not because of service or price but because they have this giant fifty foot,black and yellow blackbird statue in the parking lot)--and proceeded to reaquaint myself with wading boot prices. Having last bought wading boots circa 1990, fifteen years inflation certainly caused my jaw to drop. Outside of standing there and looking like one of the "appalachian" characters from the movie Deliverance, I was quickly convinced that my boots still had plenty of life in them, and that a "re-sole-ing" was the answer. I found that my good friend Hodgeman made felt sole replacements for my boots, and that the fifteen dollar cost was quite reasonable. I also thought this would allow me to "become one" with my boots and give me that nice "do it yourself" project, that gives one that warm satisfying moment when one feels self-suffecient. You see it coming, don't you? The instructions seemed fairly simple,Step 1: first remove the old felt soles. Since. there wasn't much felt sole left, this didn't seem like a very demanding first step.
But, what was left was secured to the bottom of the boot like a barnicle to a pier. I pulled and peeled and cut, (and at one point seriously consideredusing my Dremel tool) until finally getting enough old sole removed. Step 2: Spread a thin layer of supplied "felt sole cement" on the felt, wait 30 minutes. This went rather well. No problemo. While I waited, I "scuffed" up the bottom of the boots to help with the adhereing of the felt soles.
This seemed rather redundant, since I had gouged up the bottoms pretty well during the felt removal process. Step 3: Repeat spreading of "felt sole cement", wait thirty minutes and secure felt to bottom of boots. Note:You may want to use a generous amount of tape to help hold the felt in place and help secure the heel and toe area. Boy, was that an understatement. After about a roll of duct tape and the use of some large c-clamps that were laying around, I think I finally got the felt to adhere to the boot. I say "think", because there is so much duct tape around the boot that I can no longer even see the felt sole and can only trust that the tape has secured the two surfaces together. Not to mention that the boots now look like a pair of freakish silver Michael Jackson dancing spats or a pair of "punked out" Air FrankenJordans. Step 4: Allow eight hours drying time. This is where I am at now.Past history tells me that nothing good can come of this. I am afraid to remove the tape, feeling the same anxiety a plastic surgery patient feels when they remove the bandages. Maybe I am being a touch negative here, but I have the feeling when I remove the duct tape-- that of course assuming I can get the sticky duct tape off-- the felt sole will simply fall to the ground, be stuck to the duct tape, or that the shoes will scream"I'm alive, I'M ALIVE HA ha ha ha...." At this point I feel compelled to show you an actual "un-retouched" photo of my boot repair operation. This is what they have become! Perhaps, the boots will remain shaped in this contorted figure that the duct tape-clamping combination has transformed them into. With my luck, I will be walking around with the toes pointed skyward like some "pixie shoed- fishing gnome", with leaves all stuck to the outer surface because of the tape "residue" left on the outside of the boot!! Maybe, the soles will initially be fine and as soon as I hit the cold clear water of the Rogue river they will just simply shrink up and fall off.We all know about shrinkage and cold water-now don't we fellas?! I just have a BAD FEELING about this!! At any rate, I will be back down at the "Blackbird" this afternoon repricing wading boots. As usual, I will have spent fifteen dollars more than the actual price of the boots, and wasted two hours "becoming one" with my boots. I don't know what it is that makes us fishermen so frugal and why I continually get sucked into thinking I can "do-it-myself", but I know this won't be the last time... ...In fact, there is this pin hole in my breathable waders somewhere that I can't find, anyone know how much a patch kit is? This is like a profile that they use to match individuals that have similar interests, backgrounds, etc. This is so that you (the mentoree) feels more comfortable and at ease with your mentor. If you know the area that you want to study, then your particular department may have someone who is majoring in the same field. This is one more thing that can you and your mentor together and provide with an even more personalized level of service. Once you are paired with your mentor, you will feel more at ease with your transition from high school life to college life. Your mentor may open up doors of opportunity for you that you may not have known existed without him or her as your guide. Franchise Agreements and Marketing Areas

By Lance Winslow Some franchising companies will use the method of selling master franchisees in specific regions to expand their brand-name and grow their companies. Each time a master franchisees sold a new marketing area in region of influence will be established, where the master franchises will in turn sell other franchises. The marketing area will need to be clearly defined and delineated on a map and a description of what the marketing area will consist of must also be clearly stated in the franchising agreements. It is for this reason that below I have listed a clause which I put into our franchise agreements for our master franchises which discusses the marketing area for master franchise operations; 1.2 Marketing Area Franchisee is hereby granted a nonexclusive Marketing Area defined by geographic boundaries as determined by Franchisor in its sole discretion after giving considerations to relevant demographic information, including the number of vehicles, population and demographics, the actual boundaries of which are set forth on Exhibit 1 attached to this Agreement. Franchisee may not conduct any advertising that is circulated outside the Marketing Area or otherwise solicit customer accounts that are located outside the
Marketing Area without the prior written consent of Franchisor. Franchisee may not solicit customers within the Marketing Area with respect to Services that would be provided to such customers both within and outside the Marketing Area (such customer being referred to as a National or International Account) without the prior written consent of Franchisor. In the event Franchisee enters into an agreement to provide Services to a National or International Account, Franchisees agreement in respect thereof must provide that Services for locations other than in the Marketing Area must be subcontracted to other Car Wash Guys Franchisees in their licensed marketing areas (Other Franchisees), if any. Franchisor, in its discretion, may establish other Franchisees who may advertise and solicit customer accounts within the Marketing Area and who may be in competition with Franchisee. In addition, Franchisor retains the right to solicit and sell National or International Accounts within the Marketing Area, including but not limited to solicitation and sales via direct marketing campaigns, telemarketing, and by use of the Internet and other on-line computer networks. Franchisee may not, directly or indirectly, sell, offer to sell, or provide any of the Services to any person or legal entity that is under contract with, is a current customer of, or was invoiced within the previous six (6) months (Customer Accounts) by, another Car Wash Guys Franchisee who has been granted a marketing area that overlaps (in part or whole) with the Marketing Area described in this Section 1.2 and Exhibit 1 of this Agreement (Overlapping Franchisee). The provisions of this paragraph shall apply only to Customer Accounts in which the customer is located in both Franchisees Marketing Area and in a Overlapping Franchisees marketing area (Overlapping Territory), and are intended to be broadly interpreted to prevent Franchisee from directly or indirectly interfering with any of the customer relationships that have been established by an Overlapping Franchisee in Overlapping Territory. The provisions of this paragraph shall not apply if Franchisee obtains written permission, granted by the President, Vice President or Continent Franchisor Director (CFD) of the Franchisor, to engage in conduct that otherwise is prohibited in this paragraph. If Franchisee violates any of the provisions of this paragraph, Franchisee shall pay to the Overlapping Franchisee(s) forty-three point five percent (43.5%) of the revenue derived from the Customer Accounts that caused Franchisee to violate this paragraph. Such revenue must be paid to the Overlapping Franchisee(s) with ten (10) calendar days of receiving such revenue, for so long as Franchisee receives revenue from those Customer Accounts. The Stages of Civil Litigation

By Gerard Simington Getting involved in a lawsuit can be a very stressful situation, regardless of which side you are on. To limit the stress, it often helps to understand the process and stages of litigation. What is civil litigation? Civil litigation is a lawsuit whereby a party seeks damages against another party. The damages can come in the form of money or the modification of some type of conduct. For instance, one can sue for breach of contract if another party fails to live up to the terms of a written agreement. One can also sue for a restraining order to bar a competitor from using various business property such as intellectual property rights. Importantly, civil litigation is not a criminal matter, to wit, the party that loses the case does not go to jail. The first stage of civil litigation is the pleading stage. The pleading stage simply refers to the filing of the complaint against the party that is the defendant. The defendant then has the right to contest certain elements of that complaint. The defendant can object on the grounds that the complaint does not state a cause of action against them or frivolous matters are included in the language of the complaint, to name a few arguments. At this point, the court will either find a complaint to be with or without merit. If the Court throws out the plaintiff's complaint, the plaintiff is usually allowed to amend the language and refile it. The next stage of civil litigation is discovery. Discovery is simply the process of learning what evidence each side has regarding the dispute. Typically a party can ask to see any supporting documents the other side has and ask them questions. Questions can be asked in written form through a legal document known as interrogatories. Questions can also be asked orally by the party's legal counsel in a process known as a deposition. Other methods of discovery also include request for admissions, special interrogatories and various other methods specific to your state. Yep, all the rules are set forth by state in most cases. Once discovery comes to a close, the defendant will often file something known as a motion for summary judgment. A summary judgment motion is simply an argument by the defendant that the evidence provided by the plaintiff in the case does not support a claim against the defendant. In moving for summary judgment, the court considers the law on the books and the evidence provided by the plaintiff. It views the evidence in a light most favorable to the plaintiff before making the decision. If the court finds in favor of the defendant, the lawsuit is over. At this point, the plaintiff can either abandon the lawsuit or file an appeal to have a higher court review the matter. Assuming the plaintiff survives a motion for summary judgment, the next technical step of a lawsuit is to actually go to trial. Before that happens, however, the parties are usually sent to an arbitration hearing in which a mediator tries to cut a deal between the parties. This process is also known as a settlement conference. If they settlement cannot be reached, the court will then set the matter for trial and off you go. At the end of the day, the average civil lawsuit will take a while to get from filing of the complaint to trial. The exact time is dependent upon the state you live in and how busy the courts are. Criminal matters tend to take precedent over civil matters, so you can often be waiting awhile. In fact, it can often take a year or more before a civil matter goes to trial. Doorstep Lenders Receiving Unwanted Interest

Doorstep loans offer small short-term loans to people who are on low incomes or without access to bank accounts, with repayments being collected weekly or fortnightly by collectors who directly call at the customer's homes. Peter Freeman, chairman of the CC, said, "Customers value home credit because it suits their needs very well but the fact is that they are paying too much for it, because of the lack of competitive pressure in the market." The regulator found that the lack of competition in the home credit market has meant that customers had, in their opinion, been overcharged by 500m during the past five years. Peter Freeman believes, "Price competition between the existing lenders is weak, partly because customers seem insensitive to prices, given the greater value they place on factors such as the convenience of the loan and the difficulty in comparing prices between companies." Another suggestion to promote increased competition which was put on the table was for more data sharing with the credit reference agencies by the lenders about their customers' credit histories. The CC also threatened that if lenders did not follow the recommendations, then in future it might impose a price cap on the maximum interest payable for these types of loan. The CC's announcements have provoked a furious reaction from the doorstep lenders who have challenged the calculations and the conclusion that this sector of the loan industry was making excessive profits. A representative for Provident stated, "Customers are not being overcharged for their home credit loans nor is the home credit sector making excessive profits." Provident commented that the method of calculating the loan profitability was "flawed", as it did not include the intangible costs of running a network of agents who collected payments door-to-door. Peter Freeman, chairman of the Competition Commission, said recommendation by the CC might help to encourage some of the more mainstream banks to extend their lending practices into lending to lower-income customers. Your Supermarket vs. Your Local Friend

By Sue Neve Depending on the season and what type of food I buy, I generally do a big shop at the supermarket every two weeks or so. The odd items will need to be topped up of course, especially in the summer as fresh produce obviously doesn't last as long as tinned, packet or frozen. Most often nowadays I'll use on line shopping. Sit there on your computer, clicking away with your mouse, adding items to your virtual basket, picking a delivery date, confirming your order and your shopping is delivered to your door. You only have to pack it away in your kitchen. There's no travel involved, no hunting around the car park, battling with ignorant people who always think they 'own' a particular spot. there's no wandering around the isles with the wobbly trolley from hell, and you don't have to put up with those people who block the aisle with their trolleys and give you the evil eye if you dare to say 'excuse me please.' Even without the stress of the supermarkets, they are convenient, they're packed with almost everything you could want, under one roof. The larger ones now even sell furniture and electrical items, so you can pick up a new PC or Plasma TV with your litre of milk and box of organic free-range eggs. The supermarket is impersonal. There's a certain anonymity to shopping in one of the great big hangars of produce. There is a thought/attitude of 'I just want to get in, get my shopping and leave. I don't want to be hassled.' Supermarkets do provide a service, and in this stressful, busy world we now live in, it has become an invaluable service. What about the local store though? These can range from the very small offering only the most basic of items to the medium sized who seem to stock all the basics and a few extras. Go into any local store and a quick look around will orientate you as to where all the items are. Local shops are just that, local. There's no need to get into your car for the short drive, polluting the atmosphere. The short walk for you and your children is a great way to get out of your house, out of your car and can help you keep fit. It stops you being lazy. Customer service is much better too. At the supermarket, the checkout staff will often offer the obligatory 'Hello,' and 'Can I help you with your packing.' Rarely do you find the genuine staff for whom it is more than just a job and are actually interested in providing you with the best service possible. At the local store, the staff tend to get to know their customers. Become a regular and it will brighten your day when you enter the shop to greeted by name, and a quick conversation will make you feel less like you are just an army ant doing your job but never receiving recognition. Here are two personal examples: When I was six years old, I lived in a part of Wales until I was nine years old. The local shop was like a mecca to my sister and I. Our Mother would often send us there on errands. When I was fifteen, I re-visited that shop, and the old lady who had been proprietor back then was still there. Even though I had only lived in the area for three years as a child, and had changed quite a bit, she still remembered my Mother, sister and I.I lived in an area of Scotland for roughly eighteen months, moved away for four years, and when I came back, the shopkeeper in my local store not only remembered me, but greeted me warmly and told me it was nice to see me back.It's not that I have a memorable face. Nor is it because I am well known. It is simply because in the vast majority of cases, the local storekeepers care about the community, giving good customer service, and finding out in a personal way how better to serve your shopping needs. Use your local shop. The more people use them, the better society will become. People will enjoy shopping more, children will become educated to their community, supermarkets will have to improve in the areas they are lacking and it will help reduce pollution, as more people stop using their cars for such small journeys. Playing Hard To Get - How To Make Him or Her Want To Chase You

I mentioned that the two biggest mistakes men and women make with playing hard to get is to 1) Play hard-to-get even when they don't yet know if the other person is interested at all; 2) Play much too hard to get that the other person thinks you are not interested. If you are playing hard to get and no one is chasing you, that is not playing hard to get, that is lying to yourself. Before you start playing hard to get you must first make the sure the other person wants to play, and is interested in the chase. You must first give him or her reason to want to chase you. In the culture I was raised in, this is called: "the delicate art of arranging to be caught". It is a courtship ritual that our ancestors discovered watching the courtship behaviour of other wild animals and fine tuned it for their own use. This ritual is still part of selfishly guarded rituals and esoteric arts. The whole strategy is to give the other person the thrill of a chase when in actual fact you are the one who arranged to be caught. Ill just reveal one secret of the delicate art of arranging to be caught. Youve probably heard that its always best to leave something to the imagination. There is some sense in this in as far titillating and perhaps some extra provocation is concerned, but this is not the best way of arranging to be caught especially when the little that is revealed, shown or exposed does nothing to the imagination except to ask why? or what for? Even beautiful eyes, a sweet voice or interesting story have away of putting one off (and in some cases even distinctly revolting) if what is presented to the eyes has no apparent or sincere hint of fun and enjoyment, excitement and adventure or attraction and arousal. The other person should not have to guess about anything. Most people are unable to accurately read other peoples body language let alone their minds. Take nothing for granted. Leave nothing to guesswork. I am not suggesting that we all wear revealing clothing, eyeball or ogle at every hot man or woman, flash breasts or grab crotches la Michael Jackson; this is not leaving nothing to the imagination, its bad taste and a sign of under developed sexual and social skills. Leaving nothing to the imagination basically means that you build up enough intrigue and mystery (with every lingering look, every expression, every body move you make etc) to make the person wonder what makes you tick and what's going on in your "sexy" head. The person is excited, stimulated and aroused by their own imagination. Their own imagination feeds the thrill for the chase. You do not really have to do much but relax and wait to be caught. There is no need for any seduction techniques, no need to act like youre not as excited, no need to wait as long as you can before you call after a first date and no need to pretend to be busy etc. In fact you can call him/her everyday or go out every evening just to feed more into his/her imagination. Nothing is more powerfully seductive than a persons own imagination. So - the obvious question must be: How the heck do you work with something as high speed and fickle as the imagination? A Fly Fisher's Respect for Nature

By Steve Robbins Are fly fishers truly good stewards of our God given natural resources? Id like to think so but Im not so sure that all of us are. I would venture to assume that in fly fishing, the gentlemans sport, we have the ethical fibers within us that drive us to take good care of our rivers, lakes and streams. Is this an accurate assumption? Over the last 10 years, fly fishing has certainly been one of the fastest growing outdoor activities in North America. With this growth were sure to attract those who are less ecologically conscious that wed like. We can strive to create public awareness in the fly fishing community yet probably the best place to start is with ourselves. Marjory Douglass wrote, "The future lies within the strength with which man can set his powers of creation against his impulses for destruction." Now dont get me wrong. I would definitely never pass as a purist tree hugger. I do not intend to preach but I think there area few things that we can look at. It truly hurts me to be on a beautiful stream to come upon the discarded remains of human presence that include water bottles, beer cans and cigarette butts. I know youve all hear one of the backpackers code of ethics, "if you pack it in then pack it out". One pressing issue to consider for us nymphers is lead shot. Is it an eco sin to use lead split shot instead of tin? Of course it is! Lead is toxic and kills living creatures and you cannot seriously consider yourself a conservationist if you are intentionally putting lead into nature. Now, the lead that is accidentally dropped into nature by fly fishermen is surely a fraction of one percent of the total amount of lead that flies out of shotguns nationwide and lands in the wild, so why bother us with the issue? Because every little bit hurts. How many times have you seen a wadded and tangled leader in the stream? Have you seen the horrible images of wildlife becoming tangled in the mass of monofilament? Zane Grey wrote, "If I fished only to capture fish, my fishing trips would have ended long ago." And so it is with most considerate anglers. The thrill of the catch is often overshadowed by nature's breathtaking grandeur. I love to catch fish as much as anyone. However, when Im all alone and think back to my fly fishing adventures, I think less of the individual fish that I caught than of the places that Ive been and settings in which Ive fished. Fly fisherman become a part of the waters they fish. As naturalist John Muir observed, "When one tugs on a single thing in nature, one finds it attached to the rest of the world." We must approach our pristine waters with respect. If we do this, then perhaps we gain its total amount of enjoyment. The fish aren't always biting, but Mother Nature is always watching.
